1. Introduction

Welcome to the website of Red Berries IKE (hereinafter “Red Berries”, “the Company”, “we”, “us” or “our”), a company incorporated under Greek law, engaged in the management and letting of residential apartments in Athens, Greece, on both a short-term and mid-term basis.

By accessing or using this website (the “Site”), you (“User”, “you” or “your”) agree to be bound by these Website Terms of Use (“Policy”). If you do not agree to these terms, please discontinue use of the Site immediately.

This Policy constitutes a legally binding agreement between you and Red Berries IKE and is governed by Greek law, including but not limited to Law 4624/2019 (on Personal Data Protection), Law 4070/2012 (on electronic communications), and applicable European Union regulations including the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

3. Scope of Services

The Site provides information about Red Berries’ rental portfolio and facilitates inquiries and bookings for the following services:

Short-term rentals (STR): stays of fewer than 30 consecutive days, subject to Greek Presidential Decree 337/2000 and the applicable short-term rental registration framework under Law 4446/2016 as amended by Law 5170/2025.
Mid-term rentals (MTR): stays typically between 30 days and 12 months, governed by applicable Greek tenancy law and individual rental agreements.

All properties operated by Red Berries are duly registered with the Greek Independent Authority for Public Revenue (AADE) under the Short-Term Rental Registry where required by law. The Site does not constitute a real estate agency or brokerage service.

4. Role of Red Berries as Operator and Limitation of Liability

Red Berries IKE acts as a professional property operator, making residential apartments available for short-term and mid-term rental on the basis of management agreements, sub-lease arrangements, or other contractual arrangements concluded with the individual property owners or title holders (hereinafter “Owners”). Regardless of the specific legal basis governing the relationship between Red Berries and each Owner, the following provisions apply.

Status of Red Berries:

Red Berries operates the properties listed on this Site in its capacity as operator, not as owner. Red Berries does not hold title to the properties and its right to let each property derives from a contractual arrangement with the respective Owner.
Red Berries concludes rental agreements with Users in its own name as operator, acting within the scope of its contractual authority in respect of each property.
The existence of a management or sub-lease arrangement between Red Berries and an Owner does not affect the User’s rights under the rental agreement with Red Berries.

Responsibility of Owners:

The Owner bears primary responsibility for the structural condition, habitability, furnishing, and legal compliance of the property, including compliance with applicable fire safety, building, licensing, and registration regulations.
Red Berries does not warrant or represent the physical condition, fitness for purpose, or legal status of any individual property beyond what is expressly stated in the relevant listing.

Limitation of Red Berries’ Liability as Operator:

Red Berries exercises reasonable professional care in the selection, onboarding, and ongoing operational management of properties. However, Red Berries shall not be held liable for any defect, damage, or condition of a property that was not disclosed to or reasonably discoverable by Red Berries;
Red Berries shall not be liable for any loss, injury, or damage suffered by a User arising from circumstances that fall within the Owner’s sphere of responsibility under the applicable ownership or property law.

In the event of a dispute relating to the condition or suitability of a specific property, Red Berries will use reasonable endeavours to facilitate resolution and may, where appropriate, pursue remedies against the Owner on the User’s behalf or its own.

Nothing in this section limits Red Berries’ liability for its own acts of negligence, fraud, or wilful misconduct in its capacity as operator.

5. User Eligibility

Use of this Site and submission of any booking inquiry or rental application is permitted only for individuals who:

Are at least 18 years of age;
Have the legal capacity to enter into binding agreements under applicable law;
Provide accurate, complete, and truthful information when submitting any form or inquiry on the Site.

Red Berries reserves the right to refuse service to any User at its sole discretion, without obligation to provide reasons, where the Company reasonably suspects false information, fraudulent intent, or prior breach of a rental agreement.

6. Permitted and Prohibited Use

6.1 Permitted Use

Users may access the Site solely for lawful personal purposes, including browsing available listings, submitting inquiries, and obtaining information about rental terms and conditions.

6.2 Prohibited Use

Users are strictly prohibited from:

Using the Site for any unlawful purpose or in violation of any applicable Greek, EU, or international law;
Submitting false, misleading, or fraudulent information in any booking inquiry or registration form;
Attempting to gain unauthorised access to any part of the Site, its servers, or associated systems;
Scraping, crawling, or otherwise extracting data from the Site by automated means without the express prior written consent of Red Berries;
Reproducing, distributing, or commercially exploiting any content on the Site without written authorisation;
Transmitting any virus, malware, or other harmful code through the Site;
Using the Site to harass, threaten, or defame Red Berries or any third party;
Circumventing any technical protection measures applied to the Site.

Violation of these prohibitions may result in immediate termination of access and may expose the User to civil and/or criminal liability under applicable Greek and EU law.

7. Booking Inquiries and Rental Agreements

Any inquiry submitted through the Site does not constitute a binding reservation or rental contract. A rental agreement is formed only upon: (a) written confirmation by Red Berries; and (b) receipt of any deposit or advance payment as specified in the applicable rental terms.

For short-term rentals, bookings may also be made through authorised third-party platforms (e.g. Airbnb, Booking.com). In such cases, the terms and conditions of those platforms apply in conjunction with this Policy.

For mid-term rentals, a separate written rental agreement will be concluded between the parties, setting out the specific terms of the tenancy. In the event of conflict between such agreement and this Policy, the rental agreement shall prevail.

Red Berries reserves the right to cancel any confirmed booking in circumstances of force majeure, regulatory prohibition, or verified misrepresentation by the User, and will provide a full refund of amounts paid in such cases.

8. Payments, Fees, and Cancellation Policy

Rental prices, fees (including cleaning fees, environmental fees, and municipal tax where applicable), and payment methods are as stated in the relevant listing or rental agreement. Red Berries complies with its obligations under Greek VAT law and applicable tourist levy regulations.

Default Cancellation Policy – Non-Refundable.

Unless a different cancellation policy is expressly agreed in writing between Red Berries IKE and the User at the time of booking confirmation, all bookings made through this Site are strictly non-refundable by default. By completing a booking, the User expressly acknowledges and agrees that:

All payments are final and non-refundable in the absence of a written agreement to the contrary, including in cases of change of plans, personal emergencies, illness, travel disruption, or failure to obtain necessary travel documents;
No full or partial refund will be issued for early departures, late arrivals, or unused nights, unless otherwise agreed in writing;
Cancellation of a confirmed booking by the User results in forfeiture of all amounts paid, unless a specific refundable or flexible policy has been confirmed in writing for that booking.

Where a different cancellation policy has been expressly agreed in writing (e.g. a flexible or partially refundable arrangement confirmed by Red Berries at the time of booking), the terms of that written agreement shall prevail over this default policy.

Red Berries will issue a full refund only where it cancels a booking due to circumstances within its own control (e.g. property unavailability not caused by the User). Force majeure events – including natural disasters, pandemics, governmental restrictions, or acts of war – do not entitle the User to a refund under the default policy.

For bookings made through third-party platforms (e.g. Airbnb, Booking.com), the cancellation policy of that platform governs and may differ from the above. Users are responsible for reviewing the applicable policy on the relevant platform prior to booking.

9. Intellectual Property

All content on this Site – including text, photographs, graphics, logos, user interface design, and software – is the property of Red Berries IKE or its licensors and is protected under Greek Law 2121/1993 on Copyright and Intellectual Property Rights and applicable EU directives.

No content may be copied, reproduced, distributed, republished, or transmitted in any form without the prior written consent of Red Berries, except for personal non-commercial use and only to the extent permitted by law. Any permitted use must retain all copyright and proprietary notices.

10. Data Protection and Privacy

Red Berries IKE processes personal data in accordance with GDPR (EU) 2016/679 and Greek Law 4624/2019. By using the Site, you acknowledge that Red Berries may collect and process your personal data for the purposes of responding to inquiries, processing bookings, complying with legal obligations, and improving our services.

You have the right to access, rectify, erase, restrict processing of, and port your personal data, and to object to its processing, by contacting us at company@red-berries.com. Cookies and similar tracking technologies may be used on the Site. You may manage your cookie preferences through the Site’s consent tool or your browser settings. Continued use of the Site following the display of a cookie notice constitutes acceptance of non-essential cookies only where you have actively consented.

11. Disclaimers and Limitation of Liability

The Site and its content are provided on an “as is” and “as available” basis. Red Berries makes no representations or warranties of any kind, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of any content on the Site.

To the fullest extent permitted by applicable law, Red Berries shall not be liable for:

Any indirect, incidental, special, or consequential loss or damage arising from use of the Site;
Loss of data, revenue, or business opportunity resulting from reliance on Site content;
Temporary unavailability of the Site due to maintenance, technical failure, or events outside the Company’s reasonable control.

Nothing in this Policy excludes or limits Red Berries’ liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by Greek law.

The Site may contain links to third-party websites or platforms (including booking platforms, payment processors, and map services). Red Berries does not endorse, control, or accept responsibility for the content or practices of any such third-party sites. Users access third-party sites at their own risk and should review the relevant terms and policies independently.

Red Berries reserves the right to modify this Policy at any time. Changes will be effective upon publication on the Site with an updated effective date. Continued use of the Site following any modification constitutes your acceptance of the revised Policy. Where changes are material, we will endeavour to provide reasonable notice, which may include a notice on the Site or by email where we hold your contact details.

14. Governing Law and Jurisdiction

This Policy and any dispute arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Hellenic Republic. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece, unless mandatory consumer protection law in your jurisdiction of residence requires otherwise.
